DIY Nanny Search Kit — Terms and Conditions

These Terms and Conditions apply to your registration of interest in, access to, and use of the DIY Nanny Search Kit (the Kit) supplied by Gold Coast Nannies.

By registering your interest, completing our questionnaire, purchasing, accessing or using the Kit, you acknowledge that you have read, understood and agreed to these Terms and Conditions.

1. Registration of Interest

Before purchasing or accessing the Kit, you may be required to:

register your interest with us;

complete a short questionnaire; and

confirm your acceptance of these Terms and Conditions.

Registration of interest does not guarantee that you will be offered the Kit or permitted to purchase it.

We may contact you using the details you provide to clarify your requirements, provide information about the Kit, or advise you whether the Kit is suitable for your circumstances.

2. Copyright and Intellectual Property

The Kit, including all worksheets, templates, checklists, guides, instructions, written content, graphics, systems, processes, designs and other materials supplied as part of the Kit, is owned by or licensed to us and is protected by copyright and other intellectual property laws.

Your purchase or use of the Kit does not transfer ownership of any intellectual property rights to you.

Subject to these Terms and Conditions, we grant you a limited, non-exclusive, non-transferable licence to use the Kit for your own personal and household use.

You must not, without our prior written permission:

reproduce, copy, scan, photograph or substantially reproduce the Kit or any part of it;

distribute, publish, upload or share the Kit or its contents with others;

sell, licence, rent, lease or otherwise commercially exploit the Kit;

provide copies of the Kit to another family, household, nanny, agency, business or organisation;

modify or create derivative versions of the Kit for distribution or commercial use;

upload the Kit or its contents to websites, social media, file-sharing services or artificial intelligence systems for redistribution or commercial exploitation; or

use the Kit to create or market a competing product or service.

You may make reasonable copies of individual materials where necessary for your own personal use in conducting your nanny search, provided those copies are not shared, sold or distributed to others.

3. Personal Use Only

The Kit is intended for the personal use of the individual or household that purchases it.

If you wish to use the Kit on behalf of a business, nanny agency, recruitment service or other organisation, you must obtain our prior written permission and may be required to purchase an appropriate commercial licence.

4. Nanny Search and Screening

The Kit provides tools, information and resources to assist you in conducting your own nanny search.

The Kit does not constitute a nanny recruitment, placement, employment, legal, immigration, police-check, medical or professional screening service unless expressly stated otherwise.

You are responsible for making your own enquiries and decisions regarding any nanny or other person you consider engaging, including appropriate reference checks, identity checks, work-right checks, qualifications, police checks and other screening that may be appropriate to your circumstances.

5. No Guarantee

We do not guarantee that use of the Kit will result in finding, interviewing, selecting or engaging a suitable nanny.

The outcome of your nanny search will depend on factors outside our control, including the availability, suitability and conduct of prospective nannies.

6. Information You Provide

You agree to provide information that is accurate, current and not misleading when registering your interest or completing our questionnaire.

You are responsible for notifying us if information relevant to your registration changes.

Our handling of personal information is subject to our Privacy Policy.

7. Updates to the Kit

We may update, improve or modify the Kit from time to time.

Where appropriate, we may provide you with an updated version of the Kit or relevant materials. Updates do not transfer ownership of the underlying intellectual property to you.

8. Breach of These Terms

If you breach these Terms and Conditions, we may suspend or terminate your access to the Kit and, where legally permitted, require you to stop using, sharing or distributing the Kit.

Termination does not affect any rights or obligations that accrued before termination.

9. Consumer Rights

Nothing in these Terms and Conditions is intended to exclude, restrict or modify any rights, guarantees or remedies that cannot lawfully be excluded, restricted or modified under applicable law, including the Australian Consumer Law where applicable.

10. Changes to These Terms

We may update these Terms and Conditions from time to time.

The version applying to your purchase or use of the Kit will be the version communicated to you or made available at the relevant time, subject to any rights you have under applicable law.

11. Acceptance

By registering your interest and proceeding with the Kit, you confirm that:

you have read and understood these Terms and Conditions;

the information you have provided to us is accurate to the best of your knowledge;

you understand that registration of interest does not guarantee access to or purchase of the Kit;

you understand that the Kit remains our intellectual property; and

you agree to use the Kit only in accordance with these Terms and Conditions.

12. Our Right to Refuse a Sale

We reserve the right to decline, refuse or cancel an order or request to purchase the Kit where we reasonably consider that:

the Kit is not suitable for your stated circumstances or requirements;

the information provided by you is incomplete, inaccurate or misleading;

you have not completed the required registration or questionnaire;

you have not agreed to these Terms and Conditions;

we reasonably suspect that the Kit may be misused, copied, reproduced, resold or distributed without our permission;

there has been, or we reasonably suspect there may be, unauthorised sharing or distribution of the Kit; or

we otherwise consider that supplying the Kit would be inappropriate or contrary to these Terms and Conditions.

We will not refuse a sale for reasons prohibited by applicable law.

Where you have already paid for an order that we subsequently decline or cancel, any refund will be handled in accordance with applicable Australian Consumer Law and our refund policy.
