“The Client” or “The Family” refers to the client or employer who engages the agency to seek a Nanny for an agreed fee. “The Agency” refers to Gold Coast Nannies. The term “Candidate means the person (sub contractor) introduced by the agency.
1. The Contract
These terms and conditions are deemed to be accepted by the client upon thier application through the website or verbal instruction by the Client to the agency to submit suitable candidate for contact or interviews. All Information provided by the Client given to the Agency is correct.
The Client shall notify the agency immediately once they engage the Candidate who is introduced and supplied by the agency. As a result the Client agrees to pay an introduction fee which is usually the balance payable after you have made a deposit, in accordance with the Gold Coast Nannies Placement fees scale. It is the sole responsibility of the Client to inform the Agency if a candidate has been offered employment.
2. Fees and Guarantee
A non-refundable deposit of $250 is due to commence the search for a Nanny. This amount will be deducted from the full fee upon the successful placement of your Nanny. The balance is due before the Nanny commences her employment with you.
Deposits required for temporary nannies or other services are also non-refundable.
The Agency reserves the right to charge the Client a 5% surcharge on all accounts not settled on time, as stated in the Gold Coast Nannies Process of finding the right Nanny for your Family “policy”.
Should either party terminate employment within the first 4 weeks, the Agency will endeavour to provide a free placement within 8 weeks, unless the employer unreasonably terminated the employment. If the Client makes alternative arrangements during this time or requests no replacement to be found, no refunds will be offered. If unable to provide a suitable replacement within 8 weeks, a refund of half the placement fee will be refunded providing the following conditions have been met;
a) The agency was paid in full on time.
b) The Client notified the agency in writing within 5 working days of the reason for the termination.
c) The Agency did not have suitable clients to offer as a replacement
d) The Nanny did not leave due to unfair treatment
3. Trial Period:
You may be offered the opportunity to trial a Nanny before making your decision. This will be available for one session only unless a longer period is agreed on with the agency. (see details above for 4 week replacement period)
4. Temporary and Casual Positions
Where Nannies are placed for a temporary position (usually up to one month), the family can arrange for the Nanny to continue on a permanent basis for a placement fee. Any casual bookings must be booked through the agency and a fee of $20 is charged. If the Nanny does not continue the position for the length of the placement, the agency will endeavour to find a replacement Nanny at no further cost. The fee is non-refundable.
5. Liability
The Agency endeavours to introduce the Client to the most suitable candidates. However, it is the sole responsibility of the client to employ, double check reference and to be satisfied as to the suitability of the candidates. The agency can not accept responsibility for any inconsistency, loss or damage resulting from any negligent, dishonest or malicious act undertaken by the candidate introduced by the agency and employed by the client.
Like wise, no warranty is offered in respect of the suitability, honesty, capability or character of any candidate introduced by the agency and employed by the client.
6. Employment Obligations
Families will be aware of their employment obligations.
Gold Coast Nannies is purely an introduction agency and candidates are not the employees of the agency.
